By registering with Monitor.Us, you agree to these Terms of Service. By clicking "I Agree" or "Register" you agree to be bound by these terms. You can then proceed to our secure server to complete your registration.
By activating a service monitor, you agree that you own or have written authorization to use our service from the legal owner of the URL(s) or IP address(es) to be monitored by Monitor.Us.
Our service shall only be used in accordance with any and all applicable laws and regulations.
Customer grants permission to Monitor.Us to download files from any server monitored by the Service as part of his account services. Customer understands that operation of the Service will involve repeated access by the Service to any server monitored as part of his account services.
| 1. | All of your Content will be immediately deleted from the Service upon cancellation. This information can not be recovered once your account is cancelled. |
| 2. | Monitor.Us in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Monitor.us service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. Monitor.Us reserves the right to refuse service to anyone for any reason at any time. |
CUSTOMER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT THE CUSTOMER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS AVAILABLE" BASIS.
MONITOR.US EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED
MONITOR.US MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES MONITOR.US MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.
As part of account setup, you will select an account name and password. You are entirely responsible if you do not maintain the confidentiality of your password or account. If you learn that your password has been compromised, you must notify Monitor.Us in a timely manner of any known breach of security.
Monitor.Us may change the terms and conditions of the Terms Of Service from time to time. Upon any change in the terms and conditions of the Terms Of Service, Monitor.Us will notify you by posting the changes as a start-up screen following your account log-on. If you agree to be bound by the changes, you must again click the "I Accept" button on this start-up screen. If you do not click the "I Accept" button, you may terminate your account at any time.
Customer agrees to indemnify and hold Monitor.Us, its officers, employees and supporting contractors, harmless from any claim or demand, including attorney's fees, made by any third party due to or arising out of Customer's use of the Service, the violation of this Monitor.UsTOS by Customer, or the infringement by Customer, or other user of the Service using Customer's computer, of any property or other right of any person or entity.
Customer acknowledges that content, including but not limited to text, software, graphics, domain names, or other material presented to Customer as part of the Service ("Content") by Monitor.Us, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws; therefore, Customer is only permitted to use this Content as expressly authorized by Monitor.Us. Customer may not copy, reproduce, distribute, or create derivative works from this Content without expressly being authorized to do so by Monitor.Us.
Monitor.Us has the right to use the (company) names of their customers for marketing or promotional purposes. Monitor.Us will provide customers with an opportunity to decline this right, when this is requested from customer by e-mail: info (at) monitis.com
